OrderChaw — Terms of Service

Welcome to OrderChaw. These Terms of Service ("Terms") are a legal agreement between you and OrderChaw (operated by QuoNord Technology, "OrderChaw", "we", "us", or "our"). They govern your use of the OrderChaw mobile application and related services (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. About OrderChaw
OrderChaw is a platform that connects customers with restaurants and independent delivery riders. We enable you to browse restaurants, place food orders, pay through the App, and have your order delivered. OrderChaw facilitates these transactions; the food itself is prepared by the restaurants, and delivery is performed by riders.
2. Eligibility and Accounts
- You must be at least 18 years old to use OrderChaw.
- You must provide accurate information when you create your account and keep it up to date.
- You are responsible for keeping your account credentials secure and for all activity under your account.
- You may delete your account at any time from Settings (see our Privacy Policy for how account deletion works).
3. Orders
- When you place an order, you are making an offer to purchase the selected items from the restaurant at the listed price plus any applicable delivery and service fees.
- An order is confirmed once payment is authorised and the restaurant accepts it.
- Menu items, prices, and availability are set by the restaurants and may change.
- Please provide an accurate delivery address and any instructions needed for a successful delivery.
4. Payments and Wallet
- Payments are processed securely through our payment partner, Paystack. By paying, you also agree to Paystack's applicable terms.
- OrderChaw provides an in-app wallet. Your wallet balance and transaction history are maintained in the App.
- Prices are shown in Nigerian Naira (₦) and may include delivery fees, service fees, and applicable taxes.
- Where payouts apply (for example, to riders or restaurant partners), funds are transferred through Paystack to the bank account you provide.
- You agree not to attempt to manipulate, tamper with, or defraud the wallet, payment, or payout systems. We maintain server-side controls and reconciliation to protect against misuse.
5. Cancellations and Refunds
- Because food is prepared fresh, cancellation windows are limited. Whether an order can be cancelled depends on its stage (for example, whether the restaurant has started preparing it).
- Refunds, where applicable, are handled according to our policies and the circumstances of the order, and may be credited to your wallet or original payment method.
- If something goes wrong with your order, contact support@orderchaw.com and we will work to resolve it fairly.
6. Delivery
- Delivery is carried out by independent riders. Estimated delivery times are estimates, not guarantees, and can be affected by traffic, weather, restaurant preparation time, and other factors.
- You agree to be reachable (for example, by phone) and available to receive your order at the address you provide.
- To coordinate a delivery, your contact details and the rider's contact details may be shared between you as described in our Privacy Policy.
7. Your Responsibilities
You agree not to: - Use the App for any unlawful, fraudulent, or harmful purpose. - Provide false information or impersonate another person. - Interfere with, disrupt, or attempt to gain unauthorised access to the App, its systems, or other users' data. - Misuse the wallet, payment, or promotional features. - Harass, threaten, or abuse restaurants, riders, or our staff.
We may suspend or terminate your account if you breach these Terms or misuse the service.
8. Location and Permissions
The App may request permission to use your device location while you are using the App to set your delivery address and show nearby restaurants, and to access your photo library if you choose to set a profile picture. You can manage these permissions in your device settings at any time.
9. Intellectual Property
The App, including its design, logos, text, and software, is owned by OrderChaw (QuoNord Technology) and protected by law. You may use the App only for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of the App without our permission.
10. Disclaimers
- OrderChaw provides the platform "as is". While we work hard to keep it reliable, we do not guarantee that the App will always be available, uninterrupted, or error-free.
- Restaurants are responsible for the quality, safety, and accuracy of the food they prepare. Riders are responsible for carrying out deliveries. OrderChaw facilitates these services but does not itself prepare food.
11. Limitation of Liability
To the maximum extent permitted by law, OrderChaw will not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms limits any rights you have that cannot be limited under applicable law.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of the App after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles.
